The Utah Limited (Special) Power of Attorney advances to bestow selected permissions to another person through a written legal document. For occasions that require an alternate individual to make decisions, sign, or act on behalf of another party, a limited power of attorney can assist in granting precise controls for an appointed period. The document allows the principal to provide their own language to define the criteria and reach of the gained powers. Identification of the declarant and nominated attorney-in-fact must be notated in the contract, along with the respective contact information. Notarization by a licensed professional is obligated to ensure the certification of the agreement.

Statute – Uniform Power of Attorney Act ( § 75-9-101 – § 75-9-403)
Definition – “Power of attorney” means a writing or other record that grants authority to an agent to act in the place of the principal, whether or not the term power of attorney is used (§ 75-9-102(7)).
Signing Requirements – A notary should conduct acknowledgment of the form’s signing to affirm the bond (§ 75-9-105(1)).
