The Utah Real Estate Power of Attorney creates a valid legal contract to serve as a remedy for those seeking to allocate property ownership rights to a third party. Many circumstances can benefit from issued agency to an individual for the purpose of performing tasks associated with real estate holdings. An owner’s absence or incapacitation can warrant the transfer of rights, allowing an agent to make decisions, sign paperwork, or take action involving the designated property. The form procures a recording of the information associated with the arrangement and contributes a written register. Single or multiple controls can be delivered to the nominated attorney-in-fact, and selection can be specified individually to give the authority to purchase, sell, refinance and/or manage the property or properties at the principal’s discretion. Execution of the paperwork will require a notary to supervise and approve the event and all collected signatures.

Statute – Uniform Power of Attorney Act ( § 75-9-101 – § 75-9-403)
Definition – “Property” means anything that may be the subject of ownership, whether real or personal, or legal or equitable, or any interest or right therein. (§ 75-9-102(10)).
Signing Requirements – Legal notarization of the form is obligated to complete the transaction and institute the establishment of controls (§ 75-9-105(1)).
