The Missouri Limited (Special) Power of Attorney is designated for those who would like to stipulate their own authorities that will be granted to a person of their choice. Other forms of the POA document will already come furnished with a list of general powers that the principal can initial for conveyance to a third (3rd) party. That format may be enticing to some, but for individuals who wish to limit the range of control, the limited version may be a more favorable option. To activate this document, the principal must transcribe the essential data, write in a description of the powers being conveyed, and sign their name. (Before signing, users should strongly consider receiving the validation of witnesses and/or a notary public to guarantee a binding document.)

Statutes – Durable Power of Attorney Law of Missouri (§ 404.700 – § 404.737)
Definition – “Power of attorney”, a written power of attorney, either durable or not durable (§ 404.703(8)).
Signing Requirements – Acknowledgment of Two (2) Witnesses and/or Notary Public Recommended (If the document is durable and conveys powers related to the transfer of real property, then it must be acknowledged and recorded pursuant to Missouri’s state regulations.)
