The Louisiana Real Estate Power of Attorney is a custom POA document that is exclusively designated for the transfer of authority related to one’s real property transactions. For example, if an individual is buying a second home and is out-of-state, they can appoint an agent using this form to carry out the purchase in their name. With that said, this document is not just for purchasing, as it also allows users to grant powers associated with the selling, managing, or mortgaging of a property. The execution of this document is quite simple and merely requires the principal to supply the information relative to the arrangement which is to be accompanied by their signature. (It is suggested that the executor of this instrument have their signature verified by witnesses or an official retaining notarial powers.)

Statute – “The authority to alienate, acquire, encumber, or lease a thing must be given expressly. Neither the property nor its location need be specifically described.” (§ 2996)
Definition – “A mandate is a contract by which a person, the principal, confers authority on another person, the mandatary, to transact one or more affairs for the principal.” (§ 2989)
Signing Requirements – Acknowledgment of Two (2) Witnesses or Notary Public Recommended
