The Indiana Real Estate Power of Attorney is a suitable document for those wishing to provide another individual with personal powers concerning a piece of property in which they have an interest. Such powers could pertain to the financing, management, purchase, or sale of real estate. To effectuate this written instrument, the appointor should give a description of the parties involved, assign the tasks that the agent will have the right to carry out, and select the term that best suits their needs. Following the insertion of this data, the principal is required, by law, to sign the form under the observation of a notary public for their confirmation of the endorsement.

Statute – Real Property Transactions (§ 30-5-5-2)

Definition – “Power of attorney” means a writing or other record that grants authority to an attorney in fact or agent to act in place of a principal, whether the term “power of attorney” is used (§ 30-5-2-7).

Signing Requirements – The principal’s signature must be acknowledged by a notary public (§ 30-5-4-1(4)). (This form contains additional areas for the acknowledgment of an agent and two (2) witnesses but is not required by law.)
