The Washington Real Estate Power of Attorney is a legal document used to effectively allow an individual to establish defined rights for another in reference to real estate holdings. In situations where a person cannot be present to sign for or manage the sale, purchase, or handling of owned or prospective properties, a designated agent can be appointed to do so. The written binding understanding provides the opportunity for a declarant to specify an alternate attorney-in-fact to step in to make decisions and execute contracts regarding the authorized real estate on their behalf. Termination of the extended controls can be assigned with a stipulated expiration date and/or revoked at any time by asserting revocation of the original arrangement.

Statutes – Uniform Power of Attorney Act (R.C.W. § 11-125-010 – § 11-125-903)
Definition – “Property” means anything that may be the subject of ownership, whether real or personal, legal or equitable, tangible or intangible, or any interest or right therein (§ 11.125.020(10)).
Signing Requirements – An appointed notary official or two (2) acceptable witnesses must view and confirm the form’s execution (§ 11-125-050).
