The Texas Limited (Special) Power of Attorney documents the arrangement made between a “principal” (the individual conveying the powers) and an “attorney-in-fact” (the agent receiving the authority to act on the principal’s behalf). With this particular instrument, principal parties can specify the exact performance(s) that they want to be carried out by their agent, as opposed to a general or durable POA that designates a broader scope of financial authority.
To properly implement the document, the executor should provide the personal details of both parties, write in a description of the powers that they wish to grant, and select the term of the instrument. This information should be followed up with the principal signing the form while being observed by a notary public for authentication purposes (this form also contains an area for witness acknowledgment if the principal would like to further legitimize the document, it is not required).
