The Ohio Living Will, or as referred to within the content of the state’s law, a “declaration”, is the official instrument harnessed by those seeking to establish their needs & wants regarding certain medical care that is to take place if they ever suffer a serious health emergency. When tragedy occurs and someone is incapacitated due to life-threatening circumstances, it can be difficult for the family to make decisions concerning life-sustaining/life-ending care for their loved one. To avoid this, individuals can accomplish a copy of the living will document to specify how they would like things handled in case they ever wind up in an unresponsive state.

Statute – § 2133.02

Definition – “Declaration” means a written document executed in accordance with § 2133.02 of the Revised Code (§ 2133.01(F)).

Signing Requirements – Executors of this instrument may either sign in the presence of two (2) eligible witnesses (§ 2133.02(B)(1)) or while under the review of a notary public (§ 2133.02(B)(2)).
