The New Hampshire Real Estate Power of Attorney serves to officially convey powers inherent in owning a piece of real estate to an individual other than the property holder. Typically this form is used to allow substitution of an attorney-in-fact to make decisions, sign, and act without the presence legal property owner. The bestowed privileges can be granted concerning the indicated property according to the need of the principal party to include one or more of the following acts:
- Selling of the Property
- Buying of the Property
- Managing of the Property
- Refinancing of the Property
Preparation of the contract can also be used as a preemptive measure to nominate an agent should the declarant become physically or mentally incapable.

Statute – New Hampshire Statutes – Uniform Power of Attorney Act (§ 564-E:101 – 564-E:403)
Definitions – “Power of Attorney” means a writing or other record that grants authority to an agent to act in the place of the principal, whether or not the term power of attorney is used (§ 564-E:102(15)).
Signing Requirements – Notary approval will need to be confirmed with an authorized signature at the moment of execution (§ 564-E:105(b)).
