The Montana Motor Vehicle Power of Attorney is a standard representation agreement administered from the owner of a vehicle to a nominated agent. The inherent powers held by the principal party can be formally bestowed upon the named attorney-in-fact to permit transfer, registration, title, or licensure of a vehicle. Legal documentation additionally requires a notary to verify the participants’ comprehension of the commitment and witness the execution process.

Statute – Title 72, Chapter 31, Part 3: Montana Uniform Power of Attorney Act

Definition – “Power of attorney” means a writing or other record that grants authority to an agent to act in the place of the principal, whether or not the term power of attorney is used (§ 72-31-302(7)).

Signing Requirements – A notary official must substantiate the form’s execution by supplying their signature in addition to the signatures of the vehicle owner (§ 72-31-305).
