The Delaware Limited (Special) Power of Attorney is a more particular document that enables the conveyor to specify the exact performance they would like the agent to carry out. With some of the highly-used generic POAs, the powers are broader and less defined. With this POA, the user can be more precise and insert any limitations on the power that is to be granted. The principal should provide the details of both parties, a description of the granted permissions, and their endorsement as suggested by law.

Statutes – Title 12, Chapter 49A: Durable Personal Powers of Attorney Act (§ 49A-101 – § 49A-301)
Definition – “Power of Attorney” means a grant of authority to an agent to act in the place of the principal, whether or not the term power of attorney is used, authorizing the agent to convey rights in property of the principal to the agent or any other person (§ 49A-102(10)).
Signing Requirements – Delaware legislature specifies that the form requires both a notary and one (1) witness to be on-site to confirm the endorsement process (§ 49A-105).
