The Arkansas Limited (Special) Power of Attorney can be advantageous for parties who want to transmit a particular authority to someone else. In the more common general and durable POAs, the powers tend to be broader, but with the limited version of the document, conveyors can be more specific with what they would like to grant. Once the power is transcribed to the form and the record contains all the necessary criteria, the “agent” or “attorney-in-fact” will have the right to perform the prescribed duty in the individual’s name.

Statute – Arkansas Code – Uniform Power of Attorney Act (§ 28-68-101 – 28-68-406)
Definitions – “Power of Attorney” means a writing or other record that grants authority to an agent to act in the place of the principal, whether or not the term power of attorney is used (§ 28-68-102(7)).
Signing Requirements – To achieve an active document, the principal must sign in the presence of a notary public or other authorized individual (§ 28-68-105).
