Security Deposit Laws

Maximum Amount: 1 month’s rent. A landlord may charge up to 2 months’ rent if the tenant has a felony conviction or a prior court judgment for violating a lease agreement (§ 47-16-07.1(1)).

  • Receipt Required? No.

Pet Deposit: A landlord may charge an additional pet deposit of up to $2,500 or 2 months’ rent, whichever is greater, for any pets excluding service animals (§ 47-16-07.1(2)).

Return Period: The landlord must return the security deposit, plus accrued interest, within 30 days after the termination of the tenancy and delivery of possession (§ 47-16-07.1(3)).

  • Itemized List Required? Yes. If withholding funds for unpaid rent or actual damage beyond normal wear and tear, the landlord must send an itemized written accounting of the reduction within the 30-day return window (§ 47-16-07.1(3)).

Landlord Disclosures

Condition of Premises Statement: At the time of entering into a lease agreement, the landlord must provide the tenant with a written statement describing the condition of the property, which must then be agreed to and signed by both parties (§ 47-16-07.2).

Lead-Based Paint Disclosure: For residential structures constructed before January 1, 1978, landlords must distribute the federal EPA Lead Hazard Pamphlet (PDF) and disclose any known lead-based paint hazards before lease execution (40 CFR § 745.113).
