State Laws

Minimum Termination: A tenant can terminate the lease with at least 21 days’ written notice prior to the end of the current tenancy period (usually the last day of the month) (§ 13-40-107(1)(c)). Residential landlords can only terminate the lease with “just cause” (such as selling the property or moving a family member in), which requires 90 days’ written notice (§ 38-12-1303(3)(c)).

Increasing Rent: There is no statewide cap on rent increases, and state law prohibits local municipalities from enacting rent control (§ 38-12-301). Landlords must provide at least 60 days’ written notice before increasing the rent, and may only do so every 12 months (§ 38-12-701(2)(a))
