Required Disclosures (3)
1.) Agency Consent Agreement: This document ensures that the buyer and seller understand which party the real estate agent represents (201 KAR 11:121)
2.) Lead-Based Paint Disclosure: If the property was constructed before 1978, the seller must disclose any known lead-based paint hazards and provide buyers with a federally-approved lead hazard pamphlet (42 U.S. Code § 4852d).
3.) Seller’s Disclosure of Property Condition (KCREC Form 402): This mandatory document encompasses all of Kentucky’s required disclosures, including known defects regarding the home’s structure, systems, and environmental hazards (§ 324.360)
