The Utah General (Financial) Power of Attorney chronicles and legitimizes the accord to issue a range of powers to a third party for one or multiple aspects of a person’s financial, tax, or legal affairs. Statute – Uniform Power of Attorney Act ( § 75-9-101 – § 75-9-403)
Definition – “Power of attorney” means a writing or other record that grants authority to an agent to act in the place of the principal, whether or not the term power of attorney is used (§ 75-9-102(7)).
Signing Requirements – It is mandated that a licensed notary be present during document signing and apply their signature to certify the act (§ 75-9-105(1)).
