The South Dakota Limited (Special) Power of Attorney defines the associated terms and conditions for bestowed agency administered to an alternate individual for a designated period. The form is used for a principal party to initiate a written specification regarding the issued controls in the provided spaces. The document can be adjusted to include language to cover the precise fashion in which financial, legal, or tax powers will be granted and what powers will be designated to the attorney-in-fact. The principal and confirmed agent must sign before a notary official to legally instate the accord.

Statute – South Dakota Uniform Power of Attorney Act (§ 59-12-1 – § 59-12-43)

Definition – “Agent,” a person granted authority to act for a principal under a power of attorney, whether denominated an agent, attorney-in-fact, or otherwise. The term includes an original agent, co-agent, successor agent, and a person to whom an agent’s authority is delegated (§ 59-12-1(1)).

Signing Requirements – Notary affirmation is necessary to properly certify the finalization of the paperwork (§ 59-12-4).
