The South Carolina Limited (Special) Power of Attorney allows a purveyance of delivered privileges to a representative exclusively for precisely indicated financial matters mentioned within the agreement. The special granting of controls gives the principal the opportunity to enter the preferred language to properly highlight the exact powers to be extended to the denoted agent. This type of arrangement is generally used when a small number of permissions must be allotted to another at the request of the declarant. Reference to the expiration date of the agency can be recorded to annul the commitment, or an executed revocation contract can be completed to terminate the issuance. A limited power of attorney form is not a durable legal understanding, therefore it will cease to be valid should the grantor’s incapacity take place.

Statute – South Carolina Uniform Power of Attorney Act (§ 62-8)

Definition – “Agent” means a person granted authority to act for a principal under a power of attorney, whether denominated an agent, attorney-in-fact, or otherwise. The term includes an original agent, coagent, successor agent, and a person to whom an agent’s authority is delegated. An agent is a fiduciary (§ 62-8-102(1)).

Signing Requirements – A notary’s presence is necessitated to supervise and confirm the endorsing of the paperwork by all participants, including two (2) admissable witnessing individuals (§ 62-8-105(2)).
