The Rhode Island Medical Power of Attorney supports the permittance of a nominated person to assume agency over another’s health care treatment options. This precautionary legal arrangement serves to aid in indicating a trusted individual to take over the decision-making for medical situations if the principal is in a sustained unconscious state or unable to respond. Additional sections of the form can be used to record the preferences of the declarant on organ donation, life-support, and pain medication administration. The commitment is enforced upon signatures from the involved participants and either two (2) acceptable witnesses or one notary public.

Statute – Rhode Island Health Care Power of Attorney (§ 23-4.10)
Definition – “Durable power of attorney” means a witnessed document executed in accordance with the requirements of § 23-4.10-2 (§ 23-4.10-1.1(1)).
Signing Requirements – Notarization by a licensed professional or the witnessing of two (2) authorized persons required to enforce the accord (§ 23-4.10-2).
