The New Jersey Minor Child Power of Attorney conceives a recorded understanding produced by a parent to originate granted legal authorizations for another individual to care for a child and perform indicated duties. The form can be filled as needed to issue the attorney-in-fact one or multiple approved actions for a confirmed interim period. This agreement can be useful in several situations when a parent is away, such as incarceration, military service, or if the child is enrolled in another location such as a boarding school. The maximum amount of time for which the arrangement can be instated by law cannot exceed six (6) months. Another option is to execute a Designation of Standby Guardian that delivers parental permissions to an agent only after the parent is incapacitated or passes away.

Signing Requirements – It is suggested that the document be signed in the presence of a professional notary and two (2) acceptable witnesses to meet the criteria specified in state code regarding POAs and standby guardianship (§ 3B-12-74, § 3B-12-39 and § 46-2B-8.9).
