The North Dakota Minor Child Power of Attorney asserts a legal function allotting parental permissions to another individual to care for a child on behalf of a parent or parents. The lawful issuance of rights is defined within the document’s provisions to be utilized for a period no greater than six (6) months at a time. Instituting this type of contract allows a parent to designate a selected adult to make decisions for an indicated minor in the event they are not present or able to do so. Enacting the POA will initiate the passage of rights to an attorney-in-fact but will not sever the parent’s rights.

Definitions – “A parent or a guardian of a minor or incapacitated person, by a properly executed power of attorney, may delegate to another person, for a period not exceeding six months, any of the parent’s or guardian’s powers regarding care, custody, or property of the minor child or ward, except the power to consent to marriage or adoption of a minor ward” (§ 30.1-26-04).
Signing Requirements – Notary public supervision and agreement approval is necessary to effectively execute the arrangement.
