The Missouri General (Financial) Power of Attorney offers a list of various powers (related to the principal’s assets & liabilities) that can be conveyed to another individual so that they can act as the primary party. The only thing that sets this document apart from your more traditional POA is the fact that it expires upon the principal’s disability/incapacity (not durable). Once accomplished, the appointed party will have the right to operate as the grantor in any capacity necessary to achieve the assigned tasks contained within the instrument. It is effectuated by filling in each field with the requested data and providing the necessary signatures (should be performed under the review of witnesses and/or a notary public).

Laws

Statute – “Sections 404.700 – 404.735 shall not be construed to apply to powers of attorney that are not durable, except where specifically so stated; and the aforementioned sections, insofar as they apply to powers of attorney that are not durable, are intended to be declaratory of existing law.” (§ 404.730(4))

Definition – “Power of attorney”, a written power of attorney, either durable or not durable (§ 404.703(8)).

Signing Requirements – Acknowledgment of Two (2) Witnesses and/or Notary Public Recommended
