The Maine Real Estate Power of Attorney is of great benefit to individuals who need an agent to carry out real property transactions on their behalf. When someone cannot be present for their own personal real estate dealings, whether they are out of town, indisposed, or just too busy with other things, they may wish to have a representative handle these affairs for them. In order for the representative to legally act in their place, the primary individual will need to grant them the ability to do so by completing a copy of this document. Executors of this instrument will have the capability to assign tasks related to the buying, selling, financing, and management of a premises, therefore allowing the attorney-in-fact to receive and sign any necessary paperwork concerning the delegation. Individuals may establish this arrangement by filling out the form accordingly and endorsing it as proposed by state law.

Definition – “Power of attorney” means a writing or other record that grants authority to an agent to act in the place of the principal, whether or not the term “power of attorney” is used (§ 5-902(7)).
