The Maryland Durable (Financial) Power of Attorney is the statutory form issued by the state that makes it possible for private citizens to grant broad sweeping powers to an attorney-in-fact. This particular form does not convey authority related to medical decisions, but rather delegates personal financial powers that permit the agent to execute matters relative to the principal’s property, banking, benefits, fiscal responsibilities, etc. To incorporate this document, users must elect an agent (coagents & successor agents are also an option), provide special instructions if necessary, and sign it along with witnessing parties and a notary public.

Definition – “Durable power of attorney” means a power of attorney by which a principal designates another as an attorney-in-fact or agent and the authority is exercisable notwithstanding the principal’s subsequent disability or incapacity (§ 17-105(a)).
