The Illinois Limited (Special) Power of Attorney is an efficient way to designate a third (3rd) party with the right to perform a specific assignment on your behalf. With many of the other versions of the POA document, users will be provided a list of broad powers that they can grant to an agent. With the limited version, the assigning party can supply the document with their own custom description of the exact authority they wish to bestow. This can all be accomplished by naming the parties involved within the content of the form, inserting a paragraph containing the precise access that the agent will receive, and endorsing the instrument while being witnessed by a neutral party as well as a notary public.

Statutes – Illinois Power of Attorney Act (755 ILCS 45)
Definition – “Agency” means the written power of attorney or other instrument of agency governing the relationship between the principal and agent or the relationship, itself, as appropriate to the context, and includes agencies dealing with personal or health care as well as property. An agency is subject to this Act to the extent it may be controlled by the principal, excluding agencies and powers for the benefit of the agent (755 ILCS 45/2-3(a)).
Signing Requirements – Acknowledgment of at least one (1) witness (second witness optional) and a notary public (755 ILCS 45/3-3(f)).
