The Florida Minor Child Power of Attorney is a form that conveys certain parental rights to a third (3rd) party so that they can temporarily care for someone that is under the age of eighteen (18) years old. The state of Florida doesn’t technically offer the use of this exact document, rather, they provide the “Petition for Concurrent Custody by Extended Family” which requires a circuit court’s approval. Also, the petitioner seeking concurrent custody must be an extended family member meeting the criteria of § 751.011(2). The term “concurrent custody” means that the parent(s) conveying the authority will still retain all their maternal/paternal rights to the child and ultimate control over the situation.

Definition – Concurrent Custody (§ 751.011(1))
Signing Requirements – Extended family members petitioning for the concurrent or temporary custody of a minor child must sign any of the approved family law forms required by the Florida Supreme Court (some forms will necessitate the acknowledgment of a notary public). In addition, the petitioner must acquire the parent’s consent using the waiver form mentioned above. This form requires each parent to sign their own copy in the presence of a notary public (§ 751.02(1)(a)).
