The Delaware General (Financial) Power of Attorney conveys authority relative to an individual’s personal finances & assets. Unlike the durable POA, it does not function beyond the principal becoming mentally (or physically) debilitated. To effectuate the instrument, the designator of powers must transcribe the name & address of their agent (and additional/successor agents if desired), specify the types of authority they wish to bestow, and then sign the form in accordance with state law.

Statutes – Title 12, Chapter 49A: Durable Personal Powers of Attorney Act (§ 49A-101 – § 49A-301)
Definition – “Power of Attorney” means a grant of authority to an agent to act in the place of the principal, whether or not the term power of attorney is used, authorizing the agent to convey rights in property of the principal to the agent or any other person (§ 49A-102(10)).
Signing Requirements – Valid notarization of the document must occur along with endorsement confirmation from one (1) witnessing party (§ 49A-105).
