Security Deposit Laws

Maximum Amount: There is no limit on the amount a landlord can request for a security deposit (§ 6-321).

  • Receipt Required? No.

Return Period: The landlord must return the security deposit within 21 days of the tenant moving out, unless an alternate return period is written into the lease. The alternate return period may not exceed 30 days (§ 6-321(2)).

    • Itemized List Required? Yes. If any of the deposit is withheld, the partial refund must include a signed statement describing a detailed list of the expenses and amounts retained by the landlord (§ 6-321(2)).

Landlord Disclosures

Bunker Hill Superfund Site Environmental Disclosure (if applicable): If the property is located on the Bunker Hill Superfund Site in Northern Idaho, the landlord must request this disclosure form from Idaho’s Institutional Controls Program (ICP) and submit it to the tenant (IDAPA 41.01.01, Section 511).

Landlord Contact: While optional in the state of Idaho, it is standard practice for landlords to provide their tenants with the name and contact information of the owners and/or property managers.

Lead-Based Paint Disclosure: For residential units built prior to January 1, 1978, the landlord must disclose the presence of known lead-based hazards and provide an EPA-approved informational pamphlet (40 CFR § 745.113).
