Required Disclosures (6)
1.) Agency Agreement (Owner or Purchaser): This form establishes a fiduciary relationship between a client and a real estate broker, which is required before a licensee can represent a party (§ 36-21A-130). If a real estate professional is involved in the transaction, the client must execute one of the following documents with their broker:
2.) Builder’s Energy Efficiency Disclosure: Builders of new residential dwellings must submit this form detailing the home’s energy efficiency levels and insulation values to the first purchaser (§ 11-10-8).
3.) Lead-Based Paint Disclosure: Sellers of any residential property built prior to 1978 must disclose the presence of lead-based paint and provide the buyer with a federally approved lead hazard pamphlet (42 U.S. Code § 4852d).
4.) Methamphetamine Production Disclosure: Seller must inform buyers if they have actual knowledge that the property has ever been used as a site for the manufacture of methamphetamine (§ 43-4-44).
5.) Real Estate Relationship Disclosure: Licensed real estate brokers must provide this form to consumers at the first substantive contact to explain the different roles a broker may play in a transaction (§ 36-21A-147). This document is only necessary if a real estate professional is involved in the property transaction.
6.) Seller’s Property Condition Disclosure Statement: This comprehensive form requires sellers to disclose known physical defects, structural issues, and environmental hazards regarding the property (§ 43-4-38).
