Required Disclosures (3)

1.) Lead-Based Paint Disclosure: This form alerts buyers to potential lead-based paint hazards in residential dwellings constructed before 1978 (42 U.S. Code § 4852d). It grants buyers a 10-day window to conduct risk assessments or inspections for lead paint.

2.) Property Condition Disclosure Statement (PCDS): New York State law requires sellers to answer a comprehensive series of questions regarding the structural, mechanical, and environmental condition of a home (§14-462). This form includes the following mandatory disclosures: 

  • Agricultural District Disclosure: Notifies prospective buyers whether the property is located within an agricultural district, which may involve farming practices that generate noise, dust, or odors (§ 333-c).
  • Uncapped Natural Gas Well Disclosure: Indicates whether the seller is aware of any uncapped natural gas wells on the property (§ 242)

3.) Smoke Alarm and Carbon Monoxide Detector Affidavit: This form certifies that the residence is equipped with operable smoke alarms and carbon monoxide detectors in compliance with state fire codes (§ 378(5)). This affidavit must be signed and filed before the official transfer of ownership.

Optional Disclosures (3)

1.) Agency Disclosure Form: This notice clarifies who the real estate licensees represent in the transaction. While technically required for brokers rather than sellers, this form is universally attached in transactions involving real estate agents.

2.) Bed Bug Disclosure: This form informs the buyer about any bed bug infestations within the building or specific unit within the past year. While technically mandated by New York City for leases, co-op and condominium boards frequently require this disclosure for sales to protect building residents.

3.) Homeowners’ Association / Condominium Disclosures: Buyers typically demand documents outlining the governing structure, rules, and fees of any co-op, condominium, or homeowners’ association associated with the property. These forms can be obtained from the property’s HOA, condo, or co-op board.
