Laws
Statutes – Nevada Revised Statutes – Durable Power of Attorney for Health Care Decisions (§ 162A.700 – 162A.870) and Nevada Revised Statutes – Registry of Directives for Health Care (§ 449A.600 – 449A.645)
Definition – “Advance directive” means an advance directive for health care. The term includes:
1. A declaration governing the withholding or withdrawal of life-sustaining treatment as set forth in § 449A.400 to § 449A.481, inclusive;
2. A durable power of attorney for health care as set forth in § 162A.700 to § 162A.870, inclusive;
3. An advance directive for psychiatric care as set forth in § 449A.600 to § 449A.645, inclusive;
4. A do-not-resuscitate order as defined in § 450B.420; and
5. A Provider Order for Life-Sustaining Treatment form as defined in § 449A.542.
(§ 162A.703).
Signing Requirements – Execution of the directive will require two (2) witnesses to supervise and confirm the event (§ 162A.790-2 and § 449A.433-1). It is strongly suggested that the signing occurs with the additional presence of a notary public.

How to File
The state of Nevada obligates residents to register all powers of attorney, advance directives, DNR orders, and POLST orders. The documents will need to be issued to the Secretary of State’s registry, Nevada Lockbox, to sufficiently meet imposed regulations and effectively instate the arrangement(s).
Step 1 – Complete the Advance Directive Form
The principal must fill the Advance Directive form with the applicable information and desired selections. Two (2) acceptable witnessing individuals will be required to oversee and corroborate the signing of the contract. It is necessary to supply a copy for submission while the principal party should retain the original.
Step 2 – Complete the Advance Registration Agreement Form
Enter the data associated with the registrant, primary agent, and alternate agent in the allocated spaces within the Advance Directive Registration Agreement form. Affix signatures as needed and compile the registration agreement with the finalized advance directive.
Step 3 – Submit All Forms to the Secretary of State
When all paperwork is appropriately completed and signed, it can then be sent by physical mail or faxed to the following:

Once the forms are received, they are typically approved with ten (10) business days if filed correctly. After approval, the state will send instructions for access to the documents as well as a wallet card to maintain an on-hand record of the registered account.
