The Maine Minor Child Power of Attorney is the delegation of parental authority to another individual of the mother’s/father’s/guardian’s choice. The execution of this document does not mean that the parent is giving up any custody rights to their child, but rather they are creating a situation where they and their agent will have concurrent authority over certain aspects of the minor’s life, such as schooling and healthcare. This is especially helpful to those who will be temporarily away from their child and need a trusted individual to adequately care for their son or daughter. In order for this to be achieved, the child’s parental figure will require a notary public to acknowledge their signature following the completion of the form.

Definition – “Power of attorney” means a writing or other record that grants authority to an agent to act in the place of the principal, whether or not the term “power of attorney” is used (§ 5-902(7)).
Signing Requirements – Acknowledgment of Notary Public (§ 5-905(1))
Termination Period – Twelve (12) Months (§ 5-127(1))
