The Massachusetts Revocation of Power of Attorney is the cessation of a formerly established POA instrument. Following the creation of a principal-agent relationship, the party who appointed the attorney-in-fact may later decide that they wish to cease the terms of the arrangement. The state of Massachusetts demands that the termination of such a document be done so in writing and presented to the individual who initially received the powers. The document found on this page conveys the nullification of the original form. All that is required is the facts surrounding the prior configuration and the signature of the revoking party (executors are urged to sign this instrument while being viewed by a notary public so that they may verify the endorsement).
Laws
Statute – The principal of an existing POA must deliver their agent with written notice of the revocation in order to properly terminate the relationship (§ 5-504).
Signing Requirements – Acknowledgment of Two (2) Witnesses and/or Notary Public Recommended
