The Massachusetts Minor Child Power of Attorney is carried out by a parent, legal guardian, or legal custodian to provide an agent with the ability to manage their child’s schooling and medical treatment concurrently. In the state of Massachusetts, their version of this document is actually referred to as the “Caregiver Authorization Affidavit” which basically provides all the same options. Individuals interested in this type of arrangement must supply the form with the identities of everyone involved (parent, caregiver, alternate caregiver, & child), any restrictions related to the authority granted, and the signatures of all applicable parties. (Note: The granting individual’s signature is to be performed under the review of two (2) witnesses and a notary public in order to validate the document.)

Definition – ”Caregiver authorization affidavit”, an affidavit prepared pursuant to this chapter that authorizes a designated caregiver to act relative to a minor’s education and health care (201F § 1).

Signing Requirements – The principal must sign the document in the presence of two (2) witnesses and a notary public for acknowledgment purposes (201F § 5).
Maximum Term – The term of this instrument shall last no longer than a period of two (2) years (201F § 5).
