The Hawaii General (Financial) Power of Attorney is a common document to execute for those who wish to grant broad sweeping powers that cease to continue if the principal ever becomes unable to manage their property or business affairs due to mental impairment. In fact, the expiration of the document’s terms due to the incapacity of the primary party is the only distinguishing factor that separates this instrument from the “durable power of attorney”. Apart from this, the form can provide all the necessary financial authorities one could want to convey, e.g., banking powers, real estate powers, personal property powers, etc. To put the instrument into practice, all users have to do is list the names of each party involved, indicate which rights the agent will acquire, and sign it in conformity with the local statutes.
