Required Landlord Disclosures

Identification of the Landlord or Authorized Personnel: The lease agreement must explicitly include the names and addresses of all owners, authorized agents, and property management company (§ 55-248.12).

Utility Payment Structure: Whenever landlords allocate utility bills, the details of the usage ratio must be in the lease. Additionally, this includes any fees or deposits necessary to set up an account or move out. (§ 55-226.2).

Move-In Checklist: Landlords have five days after move-ins to document current damages, while tenants have 5 days to dispute (§ 55-248.11:1).

Condo: Landlords must inform incoming tenants in multi-family buildings whenever owners apply for condominium or cooperative permits (§ 55-248.12).

Military Base or Noise Zone: For those properties that lie close to a military airbase, or area deemed as a potential “noise zone” or “accident potential zone”, full disclosure must be expressly given within the leasing document. In the case that disclosure is not carried out, the tenant may have thirty (30) days to terminate the lease (§ 55-248.12:1).

Mold: Landlords acknowledge, explicitly in writing, of viewable evidence of mold contamination within the rental residence (§ 55-248.11:2).

Lead-Based Paint (42 U.S. Code § 4852d): Federal law mandates that any residence built before 1978 include a specific discussion on the potential of exposure to lead-based paint.

Previous Manufacture of Methamphetamine on Premises (VA Code §§ 55.1-1219): Landlords inform incoming tenants of a property’s history with methamphetamine presence and manufacture (if relevant).

When is Rent Due?

Grace Period: Virginia allows lease agreements (in writing) to set or strike grace periods; however it applies a 5 day grace period to oral leases (VC § 55.1-1204).

Unpaid Rent: Landlords can serve tenants who neglect to pay rent on time with a 5-day pay-or-quit notice accordingly (Va. Code § 55.1-1245(F)).

Late Fees

Virginia allows up to a 10% late fee whenever the lease is in writing and documents such fact (Va. Code § 55.1-1204(E)).

NSF Fee

In addition to the check amount, Virginia landlords can demand up to a $50 non-sufficient funds fee, accordingly (Va. Code § 55.1-1200).

Security Deposit Maximum ($)

The State of Virginia explicitly forbids landlords from requiring more than 2 months’ rent (Va. Code § 55.1-1226(A)).

Security Deposit Return

Returning to Tenant: Tenants receive their security deposit within 45 days of lease termination (Va. Code § 55.1-1226(A).

Itemized List: Landlords must provide a list of deductions whenever returning the security; however, if this exceeds the deposit amount, they have an additional 15 days to itemize costs (Va. Code § 55.1-1226(A).

Landlord’s Right To Enter

Standard Entry: Landlords give 72 hours’ notice in order to enter to make unrequested repairs unless the tenant requests otherwise (Va. Code §§ 55.1-1229(A)(4)).

Emergency Entry: Landlords in Virginia can respond to emergencies by accessing the premises whenever immediate response is necessary (Va. Code §§ 55.1-1229(A)(4)).

Absence

Virginia allows landlords to consider abandonment once they post a 7-day notice of abandonment that the current tenant does not answer (Va. Code § 55.1-1249).

Repair and Deduct

Virigina permits tenants to deduct up to $1,500 or 1 month’s rent (whichever is greater) in qualifying circumstances (e.g., fire hazard, infestations) (Va. Code § 55.1-1244.1(B)).

When a Tenant Terminates (early)

Duty to Mitigate: Landlords are responsible for engaging mitigation efforts whenever tenants vacate (e.g., re-renting the unit or property)(Va. Code § 55.1-1251).

Domestic Violence: Virginia domestic violence victims terminate prematurely with 28 days’ notice and qualifying supporting documents:

  • Order of protection
  • “Conviction order, warrant summons, information, or indictment” (Va. Code § 55.1-1236).

Active Military: Service members, as well as their spouses, give 30 days’ notice whenever relocating under orders (50 USC 3955).

Landlord Noncompliance: Tenants serve landlords violating leases 30 days’ notice to cure or terminate while requiring remedy in 21 days (Va. Code § 55.1-1234).

Landlord Harassment: Tenants may respond to landlord harassment by seeking injunctive relief or lease termination from the courts after giving notice to cease (VA Code § 55.1-1210)

Inhabitability: Virginia permits tenants to terminate leases after 30 days’ notice whenever the landlord cannot restore habitability within 21 days (Va. Code § 55.1-1234).

Is an Oral Lease enforceable?

Virginia enforces the conditions and terms of an oral lease; however, only for 1 year (VA Code § 11-2).

Renewing a Lease

While Virginia does not permit its local governments to enact rent control laws, it makes exceptions for state-authorized affordable housing program units. ( Va. Code §§ 55.1-1204, VA Code § 15.2-2305)

Unclaimed Property

Landlords may dispose of tenant property so long as they deliver at least one notice:

  • Termination notice warning of property disposal after 24 hours (applicable to tenants with previous abandonment notices)
  • 7-day abandonment notice allowing disposal of tenant property no less than 24 hours after notice expiration.
  • 10-day written notice with property disposal occurring 11 days after the notice date ((Va. Code §§ 55.1-1254), (Va. Code § 55.1-1249).
