Minimum Termination: The landlord or tenant must provide at least one month’s written notice to terminate a month-to-month lease (§ 91.001(a)-(b)). If the termination date falls mid-month, the tenant is liable only for prorated rent up to that date (§ 91.001(b)). Landlords and tenants may agree to a different notice period—or waive the notice requirement entirely—in a signed written lease (§ 91.001(e)(1)).
Increasing Rent: Texas has no statutory limits on rent increases. Unless a specific timeline for rent increases is written into the lease, landlords can effectively raise the rent with one month’s notice by terminating the lease and offering a new one at a higher rate (§ 91.001(a)-(b)).
