Security Deposit Laws
Maximum Amount: Oklahoma has no legal limit on the amount a landlord can collect as a security deposit.
- Receipt Required? No.
Return Period: The landlord must return the security deposit, minus any lawful deductions, within 45 days after the end of the tenancy (41 O.S. § 115(B)).
- Itemized List Required? Yes. If withholding funds for unpaid rent or actual damage beyond normal wear and tear, the landlord must deliver or mail an itemized written accounting of any deductions (41 O.S. § 115(B)).
Landlord Disclosures
Flood Hazard Disclosure: If the landlord is aware, or has any reason to be aware, of any flooding the rental unit has experienced within the past 5 years, they must disclose this information prominently in the written lease agreement prior to tenancy (41 O.S. § 113a).
Lead-Based Paint Disclosure: For residential structures constructed before January 1, 1978, landlords must distribute the federal EPA Lead Hazard Pamphlet (PDF) and disclose any known lead-based paint hazards before lease execution (40 CFR § 745.113).
Methamphetamine Contamination Disclosure (if applicable): If the landlord is aware, or has reason to be aware, that any part of the premises has been used to manufacture methamphetamine, they are required to disclose this information to the prospective tenant. Disclosure is not required if certified environmental testing confirms that surface contamination levels do not exceed 0.1 micrograms per 100 square centimeters (41 O.S. § 118(C)).
Owner and Agent Information: The landlord must include in the written lease agreement the names and addresses of the owner and any individuals who are authorized to act on behalf of the owner in the management of the residence (41 O.S. § 116(A)).
Smoke Detector Testing Instructions: The landlord is required to explain to the tenant how to test the smoke detector to ensure that it is in working order. The tenant is then responsible for checking that the smoke detector is in working order (74 O.S. § 324.11a(C)).
