Security Deposit Laws
Maximum Amount: Indiana does not impose any statutory cap or limit on security deposits.
- Receipt Required? No, Indiana state law does not require landlords to provide a formal written receipt.
Return Period: Within 45 days after the lease terminates and the tenant delivers possession of the unit. This 45-day countdown does not begin until the tenant supplies the landlord with an updated mailing address in writing (IC § 32-31-3-12(a)).
- Itemized List Required? Yes, if any part of the deposit is withheld for damages, the landlord must mail the tenant an itemized list of damages along with an estimated cost of repair for each item (§ IC 32-31-3-14).
Landlord Disclosures
Flood Plain Disclosure (if applicable): If the lowest floor of the structure is at or below the 100-year frequency flood elevation, the landlord must clearly disclose in the rental agreement that the property is located in a flood plain (IC § 32-31-1-21). Landlords can use the FEMA Flood Map Service Center or the Indiana Floodplain Information Portal to determine if their property is in a flood plain.
Lead-Based Paint Disclosure: For residential units built before January 1, 1978, the landlord must disclose any known lead-based hazards and provide an EPA-approved informational pamphlet (40 CFR § 745.113).
Military Installation Proximity (if applicable): For leases entered into or renewed after June 30, 2023, the landlord must disclose in the lease if the property is located within 3 miles of a military installation and may be impacted by military operations (IC § 32-31-1-21.1).
Landlord Contact Information: At or before the start of the tenancy, the landlord must disclose in writing the name and address of an Indiana resident authorized to manage the property and receive legal notices (IC § 32-31-3-18).
Smoke Detector Compliance Form: The landlord must provide written notice at the start of the tenancy stating that the rental unit is equipped with functional smoke detectors, and the tenant must verify and sign the notice (IC § 32-31-5-7).
