State Laws

Minimum Termination: A tenant or landlord can terminate a month-to-month lease by providing at least 30 days’ written notice (735 ILCS 5/9-207). Some cities, including Chicago, have local ordinances that require landlords to provide longer notice periods (up to 120 days) depending on how long the tenant has occupied the unit (5-12-130(j)). Increasing Rent: There is no statewide cap on rent increases, and Illinois prohibits local municipalities and counties from enacting rent control ordinances (50 ILCS 825/5). State law requires landlords to give at least 30 days’ written notice before raising the rent. Local ordinances in Chicago and elsewhere may require more notice depending on the current length of tenancy.
