The California firearm (gun) bill of sale form is performed when 2 individuals partake in the sale or trade of a handgun, shotgun, rifle, etc. Before selling your gun, you should make sure that the buyer is at least 18 years of age (21 for handguns) and not a person prohibited by law. Specific details about the sale/trade must be written within the form and accompanied by signatures. Signing should be monitored by a notary public who will then validate the document by fulfilling the specified sections. (Note: All firearms must be sold by or through a dealer containing an FFL – Federal Firearms License.)

    How to Register a Gun

    When it comes to gun laws, Califonia is considered one of the most strict states in the country. Even though the state does not technically require the registration of firearms (except for assault rifles and individuals migrating to California with a firearm), there are still some steps that need to be taken in order to legally own a gun. First off, all private sales must be executed through an FFL dealer (according to § 26500). The seller transfers possession of the firearm to the dealer, who then performs a background check on the buyer (there is a mandatory 10-day waiting period for all firearm sales). Once the buyer has been approved, the dealer will hand over the firearm and the entire transaction will be recorded into the DROS (Dealer’s Record of Sale) system, which is shared with government officials.

    Gun owners who are interested in a CCW (Carry Concealed Weapon) license must consult with their local sheriff’s or police department to determine what the requirements are within that particular region. California is classified as a “may-issue” state, meaning that it is ultimately up to the discretion of the local authorities on whether or not you are deemed a viable candidate. General requirements to obtain a license include:

    • Must be at least 21 years of age or older.
    • Passed a certified handgun safety course.
    • Prepared with sufficient funds to satisfy any application fees.
    • Coincide with the following Penal Code, § 26150-26225.

    Step 4 – Firearm Details – Identify the gun being sold by answering the following inquiries:

    • Manufacturer (Make)
    • Model
    • Caliber
    • Serial Number (SN)

    Step 5 – Transaction Specifics – Input the information regarding the sale/trade that was agreed upon by both the buyer and seller:

    • Purchase Amount in Dollars (in word format)
    • Purchase Amount in Dollars (in numerical format)
    • Date of Sale/Trade (month, day, year)
    • Indicate whether or not the exchange involves a trade by checking the designated box and stipulating the terms of the agreement within the blank space.

    Step 6 – Disclosure Statements – Seller and purchaser must each read their assigned paragraph and provide a signature below if they agree with the claims made within the disclosure.

    Step 7 – Signing the Document – It is suggested that all individuals participating in the sale/trade endorse the agreement under the supervision of a notary public. The following is demanded:

    Step 8 – The last step must be executed by a notary public after witnessing the signatures of the individuals involved. To certify the form, the authorized person must supply the following within the notarial areas:

    • County in which the validation is occurring.
    • Date of Notarization (day, month, year)
    • Seller/Buyer Name
    • Signature
    • Date of Commission Expiration
