Required Disclosures (3)

1.) Groundwater Hazard Disclosure Statement: The seller must disclose the existence of wells, solid waste sites, hazardous waste, or underground storage tanks (§ 558.69). This document protects the buyer from inheriting environmental cleanup liabilities.

2.) Lead-Based Paint Disclosure: The seller must provide the buyer with documents concerning lead-based paint if the housing was constructed any year earlier than 1978 ((42 U.S. Code § 4852d).

3.) Radon Disclosure: The seller must disclose the results and dates of any known previous radon tests performed on the property (§ 558A.4). In addition to the form linked above, the seller must provide the buyer with this state-approved radon information pamphlet.

4.) Seller’s Property Condition Disclosure Form: This disclosure form must be fulfilled and delivered to the potential buyer before issuing or accepting an offer on the home (§ 558A.2). A more comprehensive version of the SPDS form is linked below.
