Statute – South Dakota Uniform Power of Attorney Act (§ 59-12-1 – § 59-12-43)
Definition – “Agent,” a person granted authority to act for a principal under a power of attorney, whether denominated an agent, attorney-in-fact, or otherwise. The term includes an original agent, co-agent, successor agent, and a person to whom an agent’s authority is delegated (§ 59-12-1(1)).
Signing Requirements – A notary must affirm the signing process with the necessary endorsement to meet the threshold of state regulation for proper completion (§ 59-12-4).
How to File
To create the designated agency, fill the form as indicated and sign in the presence of an appointed notary official. The form can then be sent to the South Dakota Department of Revenue either physically by mail or electronically by email at the following respective addresses:
