Security Deposit Laws
Maximum Amount: 1 month’s rent. If the tenant has a pet (excluding service animals), the landlord may also request an additional month’s rent as a pet deposit (§ 521-44(b)).
- Receipt Required? No, landlords are not required to provide a receipt for security deposits.
Return Period: The security deposit, or any remaining balance, must be returned to the tenant within 14 days of the end of the rental agreement (§ 521-44(c)).
- Itemized List Required? Yes. If any of the security deposit is withheld, the landlord must provide the tenant with an itemized list detailing the deductions. They must also include evidence justifying the amounts, such as invoices for repairs or cleaning (§ 521-44(c)).
Landlord Disclosures
Absentee Owner Agent Designation (if applicable): Any landlord who does not reside on the island where the unit is located must designate an on-island agent to act on their behalf, and inform the tenant in writing of the agent’s name and contact information (§ 521-43(f)).
Copy of Rental Agreement: The landlord must provide the tenant with a complete written copy of the rental agreement (§ 521-43(d))
General Excise Tax (GET) Number: The landlord must provide all tenants with their state general excise tax (GET) number in writing (§ 521-43(h)).
Landlord and Agent Identity: By the start of the tenancy, the landlord must disclose in writing the name(s) and business address(es) of any owners and property managers (§ 521-43(a)).
Lead-Based Paint Disclosure: For residential units built prior to January 1, 1978, the landlord must disclose the presence of known lead-based hazards and provide an EPA-approved informational pamphlet (40 CFR § 745.113).
Move-In Property Condition Inventory: Prior to the beginning of the occupancy, the landlord must inspect the property and make a written report of the condition of the unit, as well as inventory any appliances or furnishings provided. The tenant must be provided with a signed duplicate of said report (§ 521-42(a)).
