Security Deposit Laws
Maximum Amount: 1 month’s rent for an unfurnished unit. There is no limit for a furnished unit (§ 5514(a)).
- Receipt Required? No. A landlord is not required to provide a receipt, though they must disclose the banking institution where the funds are being kept (§ 5514(b)).
Pet Deposit Amount: Up to 1 month’s rent. Certified support animals are exempt (§ 5514(i)).
Return Period: The landlord must return the deposit, or any remaining balance, within 20 days of the tenancy’s end (§ 5514(e)).
- Itemized List Required? Yes. If the landlord makes any deductions, they must provide the tenant with an itemized list detailing the specific damages and estimated repair costs within the 20-day return window (§ 5514(f)).
Landlord Disclosures
Copy of Rental Agreement: The landlord must provide the tenant with a written copy of the rental agreement free of charge (§ 5105(b)). This rental agreement is required to include the names and business addresses of all owners and authorized property managers (§ 5105(a)).
Lead-Based Paint Disclosure: For residential units built prior to January 1, 1978, the landlord must disclose the presence of known lead-based hazards and provide an EPA-approved informational pamphlet (40 CFR § 745.113).
Summary of Landlord-Tenant Code: The landlord must supply the tenant with an official copy of the Delaware Residential Landlord-Tenant Code summary at the beginning of the rental term (§ 5118).
