State Laws

Minimum Termination: The tenant or landlord can terminate the lease with at least 60 days’ written notice. The 60-day countdown begins on the first day of the month following the notice date (§ 5106(d)).

Increasing Rent: Delaware has no state or local rent caps. Landlords must give at least 60 days’ written notice before raising the rent (§ 5107(a)). The new amount is deemed accepted unless the tenant gives notice to terminate the lease within 15 days of receiving the rent increase notice (§ 5107(b)).
