Required Disclosures (2)
1.) Annexation & City Services: Sellers of newly constructed or existing homes must state if the property is subject to city annexation or currently receives city services (§ 55-2505). This informs the buyer of potential future tax or jurisdiction changes.
2.) Lead-Based Paint Disclosure: If the property being sold was built before 1978, the seller must disclose any lead-based paint on the property and provide the buyer with a handout detailing the dangers associated with lead-based paint (42 U.S. Code § 4852d).
3.) Methamphetamine Contamination: If a property has been used for the manufacture of methamphetamine and has not been remediated to state standards, this history must be disclosed (§ 55-2508(12)). Unremediated “meth labs” are considered a public health nuisance under Idaho law.
4.) Seller’s Property Condition Disclosure (Form RE-25): Sellers must disclose all known physical defects that significantly impact the property’s value or safety (§ 55-2504). This duty is limited to the seller’s actual knowledge and does not require a professional inspection. Exemptions to this disclosure can be found here.
