What Is a Last Will and Testament?
Wyoming defines a will as “includes a codicil, a testamentary instrument that merely appoints an executor, or a testamentary instrument that merely revokes or revives another will.” (§ 2-1-301)
Requirements
To execute a valid will, individuals must:
- Be mentally sound and at least eighteen (18) years of age. (§ 2-6-101)
- The will must be signed by two competent witnesses. (§ 2-6-112)
- The will must be in writing. (§ 2-6-112)
Filing
Wyoming does not mandate filing a will before death. Some probate courts provide safekeeping services for residents who wish to store their wills securely.
