What Is a Last Will and Testament?
Wisconsin defines a will as “includes a codicil and any document incorporated by reference in a testamentary document. “Will” does not include a copy, unless the copy has been proven as a will, but “will” does include a properly executed duplicate original.” (§ 851.31)
Requirements
To execute a valid will, individuals must:
- The testator must be at least 18 years old and of sound mind. (§ 853.01)
- Sign in the presence of two (2) witnesses. (§ 853.03)
Filing
The state of Wisconsin does not require residents to file wills. However, some probate courts do provide residents with the option of depositing their documents for safekeeping for a fee.
