What Is a Last Will and Testament?
Washington defines a will as “an instrument validly executed as required by RCW 11.12.020 or 11.12.400 through 11.12.491.” (§ 11.02.005)
Requirements
To execute a valid will, individuals must:
- The testator must be mentally competent and at least eighteen (18) years of age. (§ 11.12.010)
- Two witnesses must sign the will in the presence of the testator. (§ 11.12.020(2))
- The will must be written to be valid. (§ 11.12.020(1))
Filing
Washington does not mandate the filing of wills prior to death. However, residents may deposit their wills with probate courts for safekeeping.
